Shooting Incident at 10079 Briarwild



December 14, 2015 - Charges have been filed against a burglary suspect wounded by an HPD officer at 10079 Briarwild about 2:45 p.m. on Saturday (December 12).  

The suspect, Fernando Guerrero (H/m, 35) was transported to Ben Taub General Hospital and is expected to survive his injuries. Guerrero is charged with two counts of burglary of a habitation in the 351st State District Court.  A photo of suspect Guerrero is not available for release at this time.  

Senior Police Officer M. Alva, who discharged his duty weapon, was not injured in the incident.  Officer Alva was sworn in as an officer in May 1993 and is assigned to the Northwest Patrol Division.  

HPD Homicide Division Sergeant M. Miller and Officers C. Elder and N. Sharp reported:  

HPD patrol officers responded to a burglary in-progress call at 1556 Gessner.  As officers arrived, Guerrero came out of the residence carrying a large, black, pistol-grip shotgun (later determined to be a replica).  Guerrero ran, with officers pursuing, into a nearby neighborhood and broke into a second residence on Briarwild.  Officers searching the area were flagged down by the homeowner, who told police the suspect was inside his residence.  Officers then found Guerrero in the back yard of the residence.  

Guerrero, now believed to be armed with a knife, was given repeated verbal commands that he ignored.  Officers deployed Conducted Energy Devices (CEDs) several times with no effect on Guerrero, who continued to ignore all verbal commands from officers and an HPD K-9.  Guerrero instead lunged at patrols officers and reached into his waistband.  Believing he was reaching for a weapon and fearing for his life and that of his fellow officers, Officer Alva discharged his duty weapon and struck Guerrero.  Officers managed to take Guerrero into custody and he was transported by HFD paramedics to the hospital.  

As is customary in HPD officer-involved shootings in the city limits, this case is being investigated by the HPD Homicide and Internal Affairs Divisions, as well as the Harris County District Attorney's Office.
